The Real Estate Market is changing rapidly and Oregon laws are updated with each legislative session. The Columbia Pacific Law Firm, LLC performs document review in real estate transactions, assists in contract preparation and owner financing documents and can assist a client buying or selling property with or without the aid of a Realtor.

In the current market we are seeing a number of clients requesting document review in real estate transactions. A document review looks at your contract to buy or sell property, your title report and other pertinent documents for any errors, omissions, mistakes, or red flags. We can help you decide how the property will be held and we can also evaluate that issue as part of our document review process. Unlike a Realtor, as attorneys, we can offer legal advice and also draft any documents that you may need to complete the process.

People buying or selling FSBO, (or for sale by owner) often retain CPLF for assistance drafting or reviewing their contracts under Oregon law.

Seller financing is gaining in popularity and combined with the FSBO market there are a number of factors to consider when structuring your transaction. The type of sale must be determined first. The main choices in Oregon are Lease Options, Land Sale Contracts (also known as an installment sale contract), or owner financing with a Note and Deed of Trust. There are pros and cons to each type of transaction and we work to be sure our clients understand all the options that apply in their transaction.

CPLF can also review your Real Property leases and assist in Landlord Tenant issues.

To discuss your issue with a licensed Attorney, please feel free to call for an appointment! 503 468 3100

What is an estate plan?

Many people consider a Will to be the primary focus of an Estate plan. A Will is an instrument that allocates your possessions to people, charities, or institutions. Living trusts or Living Wills have also become popular in recent years as a way to avoid probate. Probate in Oregon is not as onerous as in other states. Many clients continue to choose a Will for their basic estate plan. All of these different options should be reviewed with each client individually. Some people with larger estates find that trusts which allow the settler to manage assets during their lifetime for the benefit of their beneficiaries offer more peace of mind.

One major issue to consider is who will make decisions for you if you become incapacitated. A Power of Attorney gives another person access to your finances and can allow a spouse, sibling, or trusted friend to pay your bills, deposit and withdraw funds from your bank account, and buy or sell items on your behalf. In addition, a Health Care Directive informs medical personnel and hospitals which person is able to make medical decisions on your behalf if you are not conscious or unable to communicate your wishes.

Our firm can prepare your Will at a competitive rate. The Columbia Pacific Law Firm, LLC also offers a complete Oregon package for your estate plan; Including a Will, Power of Attorney and a free Health Care Directive.
